Terms & Conditions
Plain-English terms for our web, SEO, hosting and SaaS work: fixed written quotes, milestone payments, cancellable subscriptions, a 99.9% hosting SLA — governed by US law. Includes the 9-month free trial terms (counted from each client's own signup date) and our right to update these terms and policies at any time.

1. Agreement
These terms ("Terms") form the agreement between you ("Client") and My Homes WebExpert Limited, virtual office in Auckland, New Zealand ("we", "us"). Using our website, client portal, hosting or SaaS, or accepting a written quote, means you accept these Terms. Project-specific quotes may add terms; where they conflict, the signed quote prevails.
2. Quotes & scope
Consultations and quotes are free. Every engagement starts with a written scope: deliverables, timeline, milestones and a fixed price. Work outside the signed scope is quoted separately before it begins — we never invoice surprises.
3. Payments
Custom builds are milestone-based (typically 50% deposit, 50% on launch) unless the quote states otherwise. Hosting and My Homes WebExpert are prepaid subscriptions billed via Stripe in USD. Late payments over 14 days may pause services after written notice; a paused site or SaaS is restored within 24 hours of payment.
4. Refunds & cancellation
Subscriptions cancel anytime from the client portal and run to the end of the paid period; prepaid time is non-refundable except as US consumer law requires. Build deposits are refundable within 14 days if work has not started. Delivered milestones are non-refundable once approved in writing.
5. Client responsibilities
You provide content, feedback and access (hosting, DNS, logins) on the agreed schedule, hold rights to materials you supply, and keep portal credentials confidential. Delays on your side move milestones by the same period; we always confirm the revised dates in writing.
6. Hosting SLA — 99.9% uptime
Paid hosting plans carry a 99.9% monthly uptime SLA, measured at our edge monitors and excluding announced maintenance (48h notice) and force-majeure events. Verified SLA breaches are credited as free service days (1 day per 0.1% below target, capped at 30). Free SSL, daily backups with 30-day retention, and 24/7 support are included on all paid plans.
7. SEO engagements
SEO is a long-term partnership: one company per niche and region, structured monthly, because rankings compound over months — we give honest timelines and monthly plain-English reports. We never guarantee specific positions or dates; any such promise would be dishonest. All content and links we build for you remain yours if the engagement ends.
8. Intellectual property
On final payment you own your site design, copy and custom code outright. My Homes WebExpert, our internal frameworks and tooling are licensed to you for the subscription term, not sold. Third-party assets (fonts, stock media, premium plugins) are governed by their own licences, which we document at handover.
9. Confidentiality & data
Both sides keep shared business information confidential. Personal-data handling is governed by our Privacy Policy (US State Privacy Laws). Client sites are isolated tenants; we never mine one client's data for another.
10. Liability
To the maximum extent permitted by law, our liability for any claim is capped at the fees you paid for the affected service in the 12 months before the claim. We are not liable for indirect losses (lost profit, revenue, data beyond our backup obligations). Nothing here limits rights you hold under the NZ Consumer Guarantees Act 1993 or Fair Trading Act 1986.
11. Governing law
These Terms are governed by United States law and the courts of Delaware, United States have exclusive jurisdiction. Our Dhaka engineering office operates under these same Terms for all client work.
12. Changes & contact
My Homes WebExpert Limited may update these Terms, our Privacy Policy and any other policy or clause at any time, for example to reflect changes in law, security practice, our services or our pricing. The "Last updated" date on each page shows the latest revision, and changes take effect when posted unless a later date is stated. Material changes that affect active clients are notified by email or portal notice, in advance where practicable — and at least 30 days ahead for changes that increase fees or materially reduce a paid feature. By continuing to use our services after the effective date you accept the updated version; if you do not agree, stop using the services and cancel before that date. Changes never remove rights or obligations that arose before they took effect. Questions: info@myhomeswebexpert.com — replies within one business day.
13. Free launch offer & 9-month trial (My Homes WebExpert platform)
New My Homes WebExpert clients on the Basic, Pro or Enterprise plan receive a 9-month free trial with every module unlocked and no credit card taken at signup. The 9 months start on the date your workspace is created — your own signup date — and run for nine calendar months from that date, so each new client has their own trial period rather than a shared calendar end date. Renew manually before trial expiry to continue using the workspace. Full Access currently includes all customer modules on every plan until further notice; a scheduled end requires at least 30 days of notice, and eligible trials retain access until their own expiry. Extra storage is quoted before anything is billed. The trial is for one workspace per business, and any scheduled end to the Full Access offer is announced at least 30 days ahead — a trial that has already started keeps its full 9 months. These terms apply to the offer alongside everything else in these Terms.
14. Construction platform plan limits
Basic License: 5 users, 100 projects while free and 5 GB storage included. Pro License: 15 users, 200 projects while free and 10 GB storage included. Enterprise License: 50 users, 300 projects while free and 20 GB storage included. Projects become unlimited once paid. Extra storage is quoted before anything is billed.
